The SEC moves to settle its $152 million fraud case against RAD Diversified REIT
The SEC told the federal court in Tampa it wants to settle its July 2026 suit against the Florida REIT and its founders, which alleges they raised at least $152 million from more than 5,500 retail investors on claims that no investor had lost money. Settlement terms are not public, and the complaint’s allegations are not findings.
The Tzvi LLC read: It is a warning about self-set share prices and marketing claims in small direct-to-investor REITs.

Private real estate fundraising falls 31% to $136.8 billion through September
Closed-end real estate funds raised $30.74 billion in the third quarter, the weakest quarter since 2013, according to PERE data. Multifamily and residential took 40% of the capital and industrial 38%.
The Tzvi LLC read: Institutional money is concentrating in fewer, larger managers, which leaves less competition but also a thinner co-investment market for small syndicators raising from individuals.

DST sales reach $7.52 billion through September, up 27% and on pace for a record year
Delaware statutory trust offerings raised $838.3 million in September and about $7.52 billion for the year, against $5.9 billion a year earlier, according to Mountain Dell Consulting data; the firm projects about $10.2 billion for 2026.

The FBI opens an investigation into apartment syndicator Lurin Capital
The FBI’s Dallas office is asking investors in Lurin Capital, which built a Class C portfolio of about 10,000 units in five states, to report what they invested and what they received. The sponsor has faced lender claims on about $710 million of defaulted debt. No charges have been filed.
The Tzvi LLC read: A federal criminal inquiry changes what limited partners can recover and from whom, and it starts with the records each investor kept: subscription documents, the operating agreement and every distribution.

Blackstone seeks secondary buyers so investors can exit its $11 billion BPP U.S. property fund
Bloomberg reported that Blackstone began approaching buyers for stakes in the fund to give investors stuck in the redemption queue a way out, and cut fees 30% for 18 months for investors who largely stayed.
The Tzvi LLC read: When the largest sponsor turns to the secondary market for liquidity, investors in smaller open-end and evergreen vehicles should expect exits at a discount to stated value.

S2 Capital faces foreclosure on two more Texas apartment complexes carrying $169 million of debt
The Richmond in Dallas and Weston Medical Center Apartments in Houston were posted for September foreclosure auctions; both sit in a private multifamily REIT whose investors were told in May their equity was gone. Capital One is also suing the founder on an $11 million personal guaranty.
The Tzvi LLC read: It is the textbook floating-rate syndication failure, and the guaranty suit shows that nonrecourse sponsor debt often is not nonrecourse for the sponsor personally.
